Is the succession solvent?

 

The succession is solvent if the assets that the decedent owned were clearly greater than the debts that he owed.

Are any heirs absent?

 

The heirs are absent if they cannot be located. As long as you can get in touch with them and they can communicate their desire to accept the benefit of the succession, they are not considered to be absent, even if they reside outside of Louisiana.

Are any heirs unable to accept the benefit of the succession?

 

One reason that an heir might not be able to accept the benefit of the succession is if he is receiving Medicaid assistance, so that receiving an inheritance will disqualify him for receiving that assistance. Another reason is that if there are federal tax liens against him or a judgment has been rendered against him and recorded in the mortgage records.
